Authorize warrants to obtain blood or breath test in DUI cases

  1. This is very iportant, practical and useful legislation in the fight against alcohol and drug-related crimes. We've suffered so many DUI-related deaths in recent times. Currently, if suspects are charged under Negligent Vehicular Assault or Homicide, our evidence is limited to what the officers can get through implied consent. With fatalities and serious injury crashes, we need to have the additional search warrant tool available to put together prosecutable cases in the event the suspect refuses under implied consent.     Missoula County supports Senate Bill 42 - Authorize warrants to obtain blood or breath test in DUI cases, before the Senate on 2nd reading this afternoon. SB 42 is another positive step in strengthening Montana's DUI laws. Please support SB 42.

    Missoula County supports Senate Bill 42 - Authorize warrants to obtain blood or breath test in DUI cases, before the House on 2nd reading this afternoon. While not as effective as the original bill, as amended SB 42 is another positive step in strengthening Montana's DUI laws. Please support SB 42.
