Address bullying in the workplace

  1. Similar bills are being introduced in state legislatures across the country. There are both positives and negatives.

    Such legislation is clearly intended to provide a disincentive for employers or their agents to engage in abusive behavior, and provides a cause of action for employees who are subjected to certain hostile behaviors by their employers.

    On the negative side, employees who are reprimanded or subject to legitimate corrective action of various forms invariably feel they are being abused. As an employer or manager, sometimes you have to deliver negative messages to employees. There is potential that employers could be subjected to a costly defense of claims filed under this section of law, even in cases where the employer is engaging in legitimate corrective or disciplinary action.
