SB 379 Oppose: Makes it more difficult to adopt zoning in the County by lowering the protest requirements (from 50% and 40% to 25%) but then 'offering' the ability to override the protest if the governing body completes an onerous process to prove that: (1) the proposed zoning would not have negative economic impacts on property values and,(2) there is no less restrictive means to protect the public health, safety, morals, and general welfare. There is also a section that exempts this new law from "unfunded mandate laws" in 1-2-112 through 116. So, the cost burden of this onerous override process is on the Counties.
If the protest levels weren't lowered in this bill it probably wouldn't matter much because the county could continue to just not adopt zoning if it's protested, rather than enter into the proposed override process.

Missoula County opposes SB 379 - Generally revise county zoning laws, before House Local Government for consideration today. SB 379 effectively eliminates the ability of a majority of landowners in an area to promote effective zoning in their communities, which almost five square miles of individual landowners have requested in the Seeley Lake area. Under this bill, it appears that no county in the state will be able to either amend current zoning districts or create new ones even when requested to do so by a majority of landowners.
